Estes Termos e Condi\u00e7\u00f5es de Uso, bem como qualquer outro documento legal incorporado por refer\u00eancia (doravante, as \u201cCondi\u00e7\u00f5es\u201d), estabelecem o acordo legal entre o Talentato (doravante, \u201cTalentato\u201d, \u201ca Empresa\u201d, \u201cn\u00f3s\u201d ou \u201cnos\u201d) e qualquer pessoa que acesse ou utilize nosso site, plataformas digitais ou servi\u00e7os (doravante, o \u201cUsu\u00e1rio\u201d).<\/span><\/p><p><span style=\"font-weight: 400;\">Estes Termos regem o acesso e o uso de todas as propriedades digitais da Talentato, incluindo, entre outras, o site oficial, plataformas online, formul\u00e1rios de contato, materiais informativos, conte\u00fado digital, ferramentas, metodologias, bem como qualquer outro servi\u00e7o oferecido pela Talentato relacionado \u00e0 consultoria de recursos humanos, recrutamento e sele\u00e7\u00e3o de talentos, assessoria profissional e servi\u00e7os associados (coletivamente, o \u201cServi\u00e7o\u201d).<\/span><\/p><p><span style=\"font-weight: 400;\">A utiliza\u00e7\u00e3o do Servi\u00e7o implica o acesso a informa\u00e7\u00f5es, conte\u00fados, materiais propriet\u00e1rios, ferramentas digitais e servi\u00e7os especializados fornecidos pela Talentato, seja diretamente ou por meio de terceiros autorizados.<\/span><\/p><p><b>LEIA ESTES TERMOS ATENTAMENTE ANTES DE USAR O SERVI\u00c7O, POIS ELES AFETAM SEUS DIREITOS E OBRIGA\u00c7\u00d5ES LEGAIS.<\/b><span style=\"font-weight: 400;\"> Ao acessar, navegar ou usar o Servi\u00e7o, o Usu\u00e1rio reconhece ter lido, compreendido e concordado em ficar vinculado a estes Termos. condi\u00e7\u00f5es de pagamento aplic\u00e1veis.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Alguns servi\u00e7os podem envolver pagamentos \u00fanicos ou recorrentes.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A Talentato pode recorrer a terceiros para processar pagamentos.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Os pre\u00e7os podem ser alterados a qualquer momento, mediante aviso pr\u00e9vio quando aplic\u00e1vel.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Impostos adicionais poder\u00e3o ser aplicados, conforme o 400;\">Voc\u00ea pode cancelar os servi\u00e7os conforme acordado em cada contrato.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reembolsos n\u00e3o s\u00e3o garantidos, exceto nos casos previstos em lei ou expressamente acordados por escrito.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Para gerenciar cancelamentos ou altera\u00e7\u00f5es, voc\u00ea pode entrar em contato conosco diretamente.<\/span><\/li><\/ul><p><b>Resolu\u00e7\u00e3o de disputas<\/b><\/p><p><span style=\"font-weight: 400;\">Qualquer disputa decorrente do uso do Servi\u00e7o ou destes Termos ser\u00e1 resolvida de acordo com as leis aplic\u00e1veis no M\u00e9xico.<\/span><\/p><p><span style=\"font-weight: 400;\">Na medida do poss\u00edvel, as partes procurar\u00e3o resolver qualquer conflito de forma amig\u00e1vel antes de recorrer a medidas judiciais.<\/span><\/p><p><b>Propriedade intelectual<\/b><\/p><p><span style=\"font-weight: 400;\">Todo o conte\u00fado dispon\u00edvel no Servi\u00e7o, incluindo textos, materiais, metodologias, designs, marcas, logotipos, v\u00eddeos e ferramentas, \u00e9 propriedade da Talentato.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 estritamente proibido:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00c9 proibido copiar, reproduzir ou distribuir conte\u00fado sem autoriza\u00e7\u00e3o.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utiliza\u00e7\u00e3o de materiais para fins comerciais sem autoriza\u00e7\u00e3o.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Realizar engenharia reversa ou style=\"font-weight: 400;\">Recrutamento de candidatos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Resultados em processos de recrutamento<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Coloca\u00e7\u00e3o profissional<\/span><\/li><\/ul><p><b>Limita\u00e7\u00e3o de responsabilidade<\/b><\/p><p><span style=\"font-weight: 400;\">Na medida permitida por lei, a Talentato n\u00e3o ser\u00e1 respons\u00e1vel por:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Decis\u00f5es de contrata\u00e7\u00e3o tomadas por terceiros<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Resultados obtidos com a utiliza\u00e7\u00e3o do Servi\u00e7o<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Danos indiretos ou perdas style=\"font-weight: 400;\">Ao acessar, navegar e\/ou utilizar o site da Talentato, bem como qualquer um dos servi\u00e7os oferecidos por meio dele (doravante, o \u201cServi\u00e7o\u201d), o Usu\u00e1rio declara expressamente que possui capacidade jur\u00eddica suficiente para se vincular a estas Condi\u00e7\u00f5es, de acordo com a legisla\u00e7\u00e3o aplic\u00e1vel.<\/span><\/p><p><span style=\"font-weight: 400;\">Caso o Usu\u00e1rio n\u00e3o possua tal capacidade legal, dever\u00e1 abster-se de utilizar o Servi\u00e7o em qualquer momento.<\/span><\/p><p><span style=\"font-weight: 400;\">A utiliza\u00e7\u00e3o do Servi\u00e7o implica a aceita\u00e7\u00e3o integral, expressa e sem reservas destes Termos de Uso, bem como de qualquer outro documento legal, pol\u00edtica ou diretriz que fa\u00e7a parte dele, incluindo o Aviso de Privacidade. Estes Termos constituem um acordo vinculativo entre o Usu\u00e1rio e a Talentato.<\/span><\/p><ol start=\"2\"><li><b> Privacidade<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Proteger os dados pessoais do usu\u00e1rio \u00e9 uma prioridade para a Talentato.<\/span><\/p><p><span style=\"font-weight: 400;\">Todas as informa\u00e7\u00f5es pessoais que o Usu\u00e1rio fornecer atrav\u00e9s do site ser\u00e3o tratadas de acordo com as disposi\u00e7\u00f5es do Aviso de Privacidade, que faz parte integrante destes Termos e Condi\u00e7\u00f5es e est\u00e1 dispon\u00edvel para consulta no site.<\/span><\/p><p><span style=\"font-weight: 400;\">A Talentato poder\u00e1 coletar, usar, armazenar e, quando aplic\u00e1vel, transferir as informa\u00e7\u00f5es pessoais do Usu\u00e1rio para os seguintes fins:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Estabelecer comunica\u00e7\u00e3o com candidatos e empresas.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Presta\u00e7\u00e3o de servi\u00e7os de recrutamento, sele\u00e7\u00e3o e consultoria.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Acompanhar os processos de contrata\u00e7\u00e3o ou consultoria<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gerar estat\u00edsticas internas e melhorar a qualidade dos servi\u00e7os.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">O Usu\u00e1rio reconhece e aceita o processamento de seus dados de acordo com o exposto acima.<\/span><\/p><ol start=\"3\"><li><b> Altera\u00e7\u00f5es aos Termos e Condi\u00e7\u00f5es e ao Servi\u00e7o<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">A Talentato reserva-se o direito de modificar, atualizar ou excluir, a qualquer momento e sem aviso pr\u00e9vio, estes Termos e Condi\u00e7\u00f5es, bem como qualquer funcionalidade, conte\u00fado ou recurso do Servi\u00e7o.<\/span><\/p><p><span style=\"font-weight: 400;\">As altera\u00e7\u00f5es entrar\u00e3o em vigor ap\u00f3s a publica\u00e7\u00e3o no site.<\/span><\/p><p><span style=\"font-weight: 400;\">O uso continuado do Servi\u00e7o pelo Usu\u00e1rio ap\u00f3s a publica\u00e7\u00e3o de tais modifica\u00e7\u00f5es constituir\u00e1 sua aceita\u00e7\u00e3o t\u00e1cita das mesmas. Caso o Usu\u00e1rio n\u00e3o concorde, dever\u00e1 cessar imediatamente o uso do Servi\u00e7o.<\/span><\/p><ol start=\"4\"><li><b> Utiliza\u00e7\u00e3o do Servi\u00e7o<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">O Usu\u00e1rio concorda em utilizar o Servi\u00e7o de forma respons\u00e1vel, l\u00edcita e em conformidade com estes Termos e Condi\u00e7\u00f5es.<\/span><\/p><p><span style=\"font-weight: 400;\">A t\u00edtulo de exemplo, mas n\u00e3o se limitando a isso, s\u00e3o proibidas as seguintes a\u00e7\u00f5es:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utilizar o Servi\u00e7o para fins ilegais ou contr\u00e1rios \u00e0 legisla\u00e7\u00e3o aplic\u00e1vel.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fornecer informa\u00e7\u00f5es falsas, imprecisas ou enganosas.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Interferir, danificar ou interromper o funcionamento do site ou de seus sistemas.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tentativa de acesso n\u00e3o autorizado a bancos de dados, servidores ou sistemas relacionados.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utilizar o Servi\u00e7o para prejudicar terceiros<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">O n\u00e3o cumprimento do disposto acima poder\u00e1 resultar na suspens\u00e3o ou cancelamento do acesso ao Servi\u00e7o.<\/span><\/p><ol start=\"5\"><li><b> Servi\u00e7os oferecidos<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">A Talentato oferece servi\u00e7os especializados em recursos humanos e gest\u00e3o de talentos, incluindo, entre outros:<\/span><\/p><p><span style=\"font-weight: 400;\">Para empresas:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Servi\u00e7os de recrutamento e sele\u00e7\u00e3o de talentos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Avalia\u00e7\u00e3o t\u00e9cnica, profissional e cultural dos candidatos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consultoria em processos de recrutamento e estrutura organizacional.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Para os candidatos:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consultoria de posicionamento profissional<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Otimiza\u00e7\u00e3o de perfil (curr\u00edculo, LinkedIn, entrevistas)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Acesso a conte\u00fado de treinamento digital (v\u00eddeos, guias e ferramentas)<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">As caracter\u00edsticas espec\u00edficas de cada servi\u00e7o podem variar e ser\u00e3o relatadas em cada caso.<\/span><\/p><ol start=\"6\"><li><b> Natureza do servi\u00e7o<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">A Talentato n\u00e3o garante a obten\u00e7\u00e3o de emprego, entrevistas, ofertas de trabalho ou resultados espec\u00edficos decorrentes do uso do Servi\u00e7o.<\/span><\/p><p><span style=\"font-weight: 400;\">O Usu\u00e1rio reconhece e aceita que:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A Talentato atua exclusivamente como intermedi\u00e1ria e consultora.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Isso n\u00e3o garante a contrata\u00e7\u00e3o de candidatos nem a obten\u00e7\u00e3o de emprego.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">N\u00e3o garante resultados espec\u00edficos em processos de recrutamento ou consultoria.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">N\u00e3o existe qualquer rela\u00e7\u00e3o de emprego entre a Talentato e os candidatos ou utilizadores.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As decis\u00f5es finais de contrata\u00e7\u00e3o s\u00e3o de responsabilidade exclusiva das empresas.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Al\u00e9m disso, a Talentato n\u00e3o atua como empregadora, gestora, ag\u00eancia de coloca\u00e7\u00e3o formal ou representante legal de nenhuma das partes. No entanto, tais altera\u00e7\u00f5es n\u00e3o afetar\u00e3o os servi\u00e7os j\u00e1 contratados, exceto em caso de renova\u00e7\u00f5es ou servi\u00e7os recorrentes, situa\u00e7\u00e3o em que o Usu\u00e1rio ser\u00e1 devidamente notificado.<\/span><\/p><p><span style=\"font-weight: 400;\">O processamento de pagamentos poder\u00e1 ser realizado por meio de fornecedores terceirizados autorizados, e o Usu\u00e1rio concorda em tamb\u00e9m estar sujeito aos termos e condi\u00e7\u00f5es desses terceiros, quando aplic\u00e1vel.<\/span><\/p><p><span style=\"font-weight: 400;\">O Usu\u00e1rio concorda com:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Forne\u00e7a informa\u00e7\u00f5es de pagamento v\u00e1lidas, completas e atualizadas.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fa\u00e7a pagamentos em dia<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Considere quaisquer impostos, taxas banc\u00e1rias ou encargos adicionais aplic\u00e1veis.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">A falta de pagamento poder\u00e1 resultar na suspens\u00e3o ou cancelamento dos servi\u00e7os contratados, sem qualquer responsabilidade por parte da Talentato.<\/span><\/p><p><span style=\"font-weight: 400;\">Em caso de inadimpl\u00eancia, a Talentato poder\u00e1 suspender o acesso ao Servi\u00e7o sem a obriga\u00e7\u00e3o de reativ\u00e1-lo at\u00e9 a devida regulariza\u00e7\u00e3o.<\/span><\/p><ol start=\"9\"><li><b> Cancelamentos e reembolsos<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">As condi\u00e7\u00f5es espec\u00edficas de cancelamento e reembolso depender\u00e3o do tipo de servi\u00e7o contratado e ser\u00e3o comunicadas ao Usu\u00e1rio antes da contrata\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Em geral:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Os pedidos de cancelamento devem ser feitos atrav\u00e9s dos canais oficiais da Talentato.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ap\u00f3s o in\u00edcio da presta\u00e7\u00e3o do servi\u00e7o, n\u00e3o ser\u00e3o concedidos reembolsos, exceto nos casos previstos em lei ou em acordo expresso por escrito.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Para servi\u00e7os contratados por per\u00edodo (mensal ou outro), o acesso poder\u00e1 ser mantido at\u00e9 o final do per\u00edodo j\u00e1 pago, sem renova\u00e7\u00e3o autom\u00e1tica em caso de cancelamento.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Caso o Usu\u00e1rio n\u00e3o utilize total ou parcialmente o servi\u00e7o contratado, isso n\u00e3o lhe dar\u00e1 direito a reembolso.<\/span><\/p><p><span style=\"font-weight: 400;\">Qualquer exce\u00e7\u00e3o ao disposto acima deve ser expressamente declarada por escrito e autorizada pela Talentato.<\/span><\/p><ol start=\"10\"><li><b> Conte\u00fado do usu\u00e1rio<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">O Usu\u00e1rio poder\u00e1 fornecer informa\u00e7\u00f5es como:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Curriculum vitae<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dados profissionais<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Depoimentos ou coment\u00e1rios<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">O Usu\u00e1rio garante que as referidas informa\u00e7\u00f5es:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00c9 ver\u00eddico, atualizado e completo.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">N\u00e3o infringe os direitos de terceiros.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Ao fornecer conte\u00fado, o Usu\u00e1rio autoriza a Talentato a utiliz\u00e1-lo para fins operacionais, de avalia\u00e7\u00e3o, melhoria do servi\u00e7o e, quando aplic\u00e1vel, para fins comerciais ou de divulga\u00e7\u00e3o, sempre respeitando as normas vigentes.<\/span><\/p><ol start=\"11\"><li><b> Propriedade intelectual<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Todo o conte\u00fado do autoriza\u00e7\u00e3o pr\u00e9via por escrito.<\/span><\/p><p><span style=\"font-weight: 400;\">O uso n\u00e3o autorizado do conte\u00fado poder\u00e1 resultar em medidas legais 400;\">Danos indiretos, perda de rendimentos ou oportunidades.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">O servi\u00e7o \u00e9 fornecido &quot;tal como est\u00e1&quot;, sem qualquer ser\u00e1 independente da Talentato, que n\u00e3o ser\u00e1 respons\u00e1vel pelas obriga\u00e7\u00f5es decorrentes dessas rela\u00e7\u00f5es.<\/span><\/p><ol start=\"14\"><li><b> Sites de obriga\u00e7\u00f5es de pagamento pendentes.
